1. Agreeing to these terms
These Terms & Conditions ("Terms") are a legal agreement between you and Rogue Treasure ("we", "us", "our"). They apply to the As I Wait mobile app (the "App") and the website asiwait.com (the "Site"). By downloading, installing or using the App or the Site, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use them.
2. Who can use As I Wait
As I Wait is a casual game for everyone. If you're under 18, or under the age of majority where you live, please make sure a parent or guardian has read and agreed to these Terms with you. Parents and guardians are responsible for how children use the App.
3. Your licence to use the App
We give you a personal, non-exclusive, non-transferable, revocable licence to download the App and use it on devices you own or control, for your own non-commercial entertainment. This licence also follows the rules of the store you downloaded the App from. All rights not expressly given to you are reserved by us.
4. Price and future purchases
As I Wait is currently free, with no ads and no in-app purchases. If we ever add paid features, we'll tell you the price clearly before you buy. Payments would be handled by Google Play or the Apple App Store under their terms, and refunds would follow their refund policies. We'll never charge you without your clear action.
5. Things you agree not to do
- copy, modify, translate or create derivative works of the App or its content;
- reverse-engineer, decompile or try to extract the App's source code, except where the law allows it;
- sell, rent, sublicense or redistribute the App, or offer it through any unofficial channel;
- use cheats, bots, mods or hacks, or tamper with how the games work;
- remove or change any copyright, trademark or other notices;
- use the App or the Site for anything unlawful, harmful or abusive, or in a way that interferes with how they work or with other people's enjoyment of them;
- use our name, logo or the Waity mascot in a way that suggests we endorse you, without our written permission.
6. Duel mode and fair play
Duels are friendly games between people sharing one device. Results are for fun only. You must not use the App for gambling, betting or wagering of any kind, or offer prizes based on results. We don't keep a record of duel results, and we aren't responsible for any arrangements players make between themselves.
7. Play safely
As I Wait is made for short waits. Please stay aware of your surroundings while you play. Don't play while driving, cycling, crossing a road, operating machinery or doing anything else that needs your full attention. In duel mode, two people share one device, so hold it securely and take care of it.
Health notice. Some games include bright colours, flashing or fast-moving images. A very small number of people may have seizures when exposed to certain light patterns. If you or anyone in your family has epilepsy or has had seizures, check with a doctor before playing. Stop playing right away if you feel dizzy, have blurred vision, eye or muscle twitches, or any discomfort. Take regular breaks.
You use the App at your own risk. We're not responsible for any accident, injury or damage to your device that happens while you're using it, except where the law says we must be.
8. Your content and data
Sketches and other things you create in the App are yours. They're stored only on your device, and we have no access to them. You're responsible for any content you choose to save, share or post elsewhere, and for making sure it doesn't break the law or anyone else's rights.
Your game progress and history are stored only on your device. They can't be restored by us if you delete the App, reset your device or change phones, so we're not responsible for any lost progress.
9. Feedback and ideas
We love hearing from players. If you send us feedback, ideas or suggestions, you agree that we may use them to improve As I Wait or our other products, without any obligation to pay or credit you. Please don't send us anything you want to keep confidential.
10. Our content
The App and the Site belong to Rogue Treasure and its licensors. This includes the name "As I Wait", the Waity mascot, the games, artwork, sounds, text, logos and code, all protected by copyright, trademark and other intellectual property laws. Apart from the limited licence in section 3, these Terms don't give you any rights to them. You're welcome to share screenshots and short videos of your games on social media, as long as it's not for commercial use and doesn't suggest we endorse you.
11. Updates and availability
We may update, change, suspend or stop offering the App, the Site or any game at any time, with or without notice. Some updates may be needed for the App to keep working properly or securely. We don't promise that the App will be available on every device or operating system version, or that it will always be error-free or uninterrupted.
12. Third-party services and links
The App and the Site link to and use services we don't control, such as Google Play, the App Store, Google Firebase, Instagram, Reddit and Facebook. Your use of those services is governed by their own terms, and we aren't responsible for their content, availability or practices.
13. Disclaimer
The App and the Site are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing in these Terms limits rights you have under consumer protection laws that can't be excluded.
14. Limitation of liability
To the fullest extent the law allows, Rogue Treasure and its founders, team and partners won't be liable for any indirect, incidental, special, consequential or punitive damages. This includes loss of data, progress, profits or device functionality arising from your use of, or inability to use, the App or the Site. As the App is free, our total liability to you for any claim is limited to the amount you paid us for the App in the 12 months before the claim, if any.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.
15. Your responsibility
If you break these Terms or the law while using the App or the Site, and that leads to a claim against us, you agree to cover the reasonable costs and losses we suffer as a result, to the extent the law allows.
16. Google Play users
If you downloaded the App from Google Play, you also agree to the Google Play Terms of Service. Google is not responsible for the App or these Terms.
17. Apple App Store users
If you downloaded the App from the Apple App Store, these Terms are between you and Rogue Treasure only, not Apple. In addition:
- Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it.
- If the App fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation for the App.
- Apple is not responsible for any claims relating to the App, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, or claims that it infringes someone's intellectual property. We are responsible for handling any such claims, as these Terms require.
- You confirm that you're not located in a country subject to a US government embargo, and you're not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You also agree to Apple's Licensed Application End User License Agreement. Where it conflicts with these Terms, Apple's agreement applies.
18. Ending these Terms
You can stop using the App at any time by deleting it. We may suspend or end your right to use the App or the Site if you break these Terms. When these Terms end, your licence ends, and you must stop using the App and delete it. Sections that by their nature should continue, such as ownership, the disclaimer, limitation of liability and governing law, will continue after that.
19. Events outside our control
We're not responsible for any delay or failure to provide the App or the Site caused by events outside our reasonable control, such as natural disasters, power or internet outages, problems with app stores or service providers, or government action.
20. Governing law and disputes
These Terms are governed by the laws of India. If you have a problem, please contact us first at main@asiwait.com so we can try to sort it out informally. If we can't, any dispute will be handled by the competent courts of India, unless the consumer laws of the country where you live give you the right to bring a claim locally.
21. General
- Entire agreement. These Terms and our Privacy Policy are the whole agreement between you and us about the App and the Site.
- Severability. If any part of these Terms is found invalid, the rest stays in effect.
- No waiver. If we don't enforce a part of these Terms right away, we can still enforce it later.
- Transfer. You can't transfer your rights under these Terms. We may transfer ours, for example if As I Wait becomes part of another company, as long as your rights aren't reduced.
- Language. These Terms are written in English. If they're translated, the English version applies.
22. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the effective date at the top of this page, and for significant changes we'll let you know in the App or on the Site. If you keep using the App or the Site after a change, you accept the updated Terms.
